This document discloses the privacy practices for www.LIwellness.com , a web site owned and operated by LIFESTYLE INNOVATIONS, LLC ("LIwellness.com"). As part of the normal operation of our services we collect and, in some cases, disclose information about you. This Privacy Policy describes the information we collect about you and what may happen to that information. By accepting the User Agreement, you expressly consent to our use and disclosure of your personally identifiable information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the terms of the LIwellness.com User Agreement. This policy may change from time to time, so please check back periodically. Any changes or updates will be effective immediately upon posting to the website. By visiting and using our site, you are accepting the practices in this privacy notice, including all such changes and updates that have been made as of that date.

 
Minors
 
We do not currently accept any information submitted to or posted at our website from children under the age of 13. No information should be submitted to or posted at our website by children under 13 years of age without the consent of their parent or legal guardian. We do not allow children under 13 to open an account or to receive direct marketing communications arising from their use of our website and, therefore, we do not provide any personally identifiable information from children under 13 to any third party.

Information We Collect
 
 We collect and store information you submit on www.LIwellness.com, and information we receive through our other interactions with you. Without limiting any of the foregoing, the information we collect may include the following:

Your Registration and Other Personal Information. To fully use our services, you will need to obtain a user ID and password from your treating healthcare professional. You then need to register using our online registration form, where you can order products, register for programs and services, submit forms, make requests to receive materials, participate in online programs, fill out surveys, and communicate with Lifestyle Innovations staff members and fellow program participants. The personal information collected on these pages may include a variety of information including your name, contact details, and credit card information. If you join an online or by-phone program, it may also include your weight, your physical activities, various demographic, medical, and physical parameters, and details about the foods you eat. Unless you give us permission to do so, we will not sell, share, license, trade or rent your Personally Identifiable Information other than as specified in this Privacy Policy.

Your Usage of Our Site. We automatically track certain information about you based upon your use of our site. We use this information to conduct internal research on our users' demographics, interests, and behavior to better understand and serve our users. This information is compiled and analyzed on an aggregate basis. This information may include the URL that you just came from, which URL you next go to, what browser you are using, and your IP address.
 
Cookies. In addition, we use "cookies" on certain pages of our site. Cookies are small files that can be used to track a user's steps or automatically generate a user's password. We use the information you provide about someone else when placing an order only to ship the product and to confirm delivery. We do not share this information with outside parties except to complete that order.

Promotional Use. We use personal information about you to enhance our marketing and promotional efforts, and to improve our content and services. We may also use your information to deliver to you advertisements, new services and promotions, and other information to you that is targeted to your interests. You can avoid receiving some of this information by changing your options on your account status page.

We use your e-mail address, your mailing address, and phone number to contact you regarding administrative notices, new product offerings, and communications relevant to your use of the site. If you do not wish to receive these communications, you may have the ability to opt out on your account status page.
 
Billing and Support. If you open a credit account, we use your address and billing information to bill you and provide associated support.
 
Dispute Resolution. We use information in the file we maintain about you, and other information we obtain from your current and past activities on the Site, to resolve disputes, troubleshoot problems and enforce our User Agreement.

Healthcare Professionals. Your treating healthcare professional will have direct access to your surveys, health and weight management status. WE will also give your healthcare professional relevant updates about ongoing promotions and any new communications relevant to your use of the site.
 
Law Enforcement. We may disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us to legal liability.
 
Advertisers. We disclose aggregate information about our users to advertisers and for other marketing and promotional purposes. However, we do not disclose any personally identifying information to any of these entities.
 
LIwellness.com Site. Throughout the Site, you are identified by your User ID. You will be assigned a User ID and password from your healthcare professional, who will also have access to your information. Unless you select a unique User ID, our system automatically sets your User ID as your e-mail address. In this situation, where you are identified on the Site by your User ID, you disclose your e-mail address to other users and third parties. As a result, other users and third parties might send you unsolicited e-mail and be able to personally identify all of your activities on the Site. Although our pages are coded with robot exclusion headers, others may attempt to automatically collect your e-mail address from our site. We describe how to change your User ID below. Even if your User ID is not your e-mail address, your User ID can be used to identify you and your activities throughout the Site.
 
Third Party Suppliers. We may use third party suppliers to assist us in providing the services available on our web site. Whenever a third party supplier desires to collect information about you, you will be notified of the involvement of the third party supplier, and you will never be required to disclose and information to the third party supplier. We impose contractual restrictions on the use by third party suppliers of information concerning you, and we do not permit third party suppliers to sell your information to third parties.

 
Use by You of Information
 
 Use Limited to Site-Related Communications. Because of the nature of the services offered on LIwellness.com, LIwellness.com allows you to access other users' contact information. You may use such information only for LIwellness.com-related communications. Our Site-related communication expressly excludes unsolicited commercial messages. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances can you disclose personally identifiable information about another user to any third party without our consent and the consent of such other user after adequate disclosure. Note that law enforcement personnel, verified rights owner participants, and other rights holders are given different rights with respect to information they access.
 
No Spam. LIwellness.com and our users do not tolerate spam. Therefore, without limiting the foregoing, you are not licensed to add an LIwellness.com user to your mail list (e-mail or physical mail) without their express consent after adequate disclosure.

 
Disclosures You Make to Third Parties
 
LIwellness.com does not control the privacy policies of third parties. When you disclose information to third parties on LIwellness.com (or any other web site) about yourself, you are subject to the privacy customs and policies of that third party.

To restrict unauthorized access, maintain data accuracy, and ensure the correct use of information, we maintain appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

Although we will use all reasonable efforts to safeguard the confidentiality of the personal information concerning clients and other users of our website, transmissions made by means of the Internet cannot be made absolutely secure. We will have no liability for disclosure of such information due to errors in transmission, unauthorized acts of third parties or through the use of third party cookies including those of advertisers when you view or click on their advertisements. Once you leave our website, you will be subject to third party privacy policies, which may differ significantly from this privacy policy.

As we continue to develop our business, we might sell or buy clinics, subsidiaries, or business units. In such transactions, client information generally is one of the transferred business assets but remains subject to the promises made in the applicable pre-existing privacy policy (unless, of course, the client consents otherwise). Also, in the unlikely event that Lifestyle Innovations or substantially all of its assets are acquired, client information will of course be one of the transferred assets.
